Access Padel Club LLC ("Access Padel," "we," "us," or "our") operates the website accesspadelclub.com (the "Site"), the Access Padel mobile application, and the padel facility located at 330 Roycefield Rd, Building G, Units 3 & 4, Hillsborough, NJ 08844 (collectively, the "Services").

By providing your mobile phone number and opting in to receive text messages from Access Padel Club, you expressly consent to receive recurring automated marketing and informational text messages (including SMS and MMS) at the phone number you provided. Consent is not a condition of purchase, and you may opt in or out at any time.

Once you opt out, you will no longer receive promotional text messages from us unless you re-subscribe. Transactional messages directly related to your account (such as booking confirmations) may continue to be sent as permitted by law.

Message and data rates may apply. Your mobile carrier's standard messaging and data rates apply to any text messages we send to you or that you send to us. Access Padel Club is not responsible for any charges incurred by you from your mobile carrier as a result of receiving or sending text messages. Please contact your mobile carrier for details about your specific plan and pricing.
4.6 Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Access Padel Club makes no warranties, express or implied, regarding the ability to send or receive text messages. T-Mobile, AT&T, Verizon, and all other mobile carriers are not responsible for the content of messages sent through their networks.
4.7 No Sharing of Opt-In Data
We will not sell, rent, or share your mobile phone number or opt-in consent information with third parties or affiliates for their own marketing purposes. Your opt-in data and consent information will be used exclusively by Access Padel Club for the purposes described in this Privacy Policy.

Access Padel Club retains all rights to photographs, videos, and audio recordings taken at our facility. We may use these materials, in whole or in part, for any lawful purpose, including but not limited to:
- Marketing materials, including brochures, flyers, and print advertisements
- Website content, blog posts, and digital advertising
- Social media posts and stories on platforms including Instagram, Facebook, LinkedIn, TikTok, YouTube, and others
- Email newsletters and promotional communications
- Press releases, media coverage, and public relations efforts
- Internal training, safety, and operational purposes
- Franchise marketing and promotional materials
By entering the facility, you grant Access Padel Club a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, distribute, display, and create derivative works from your likeness, image, voice, and any statements captured in photographs, videos, or audio recordings taken at our facility, without further notice or compensation.
6.3 Opt-Out for Photography
If you do not wish to be photographed or filmed, please notify a staff member upon arrival at the facility. While we will make reasonable efforts to accommodate your request during dedicated photo or video sessions, please be aware that you may appear incidentally in general facility footage, and we cannot guarantee exclusion from all background imagery. If you identify yourself in a published photograph or video and wish to have it removed, please contact us at info@accesspadelclub.com and we will make commercially reasonable efforts to remove or obscure your likeness.
6.4 Minors in Photography
For participants under the age of 18, consent to photography and filming is provided by the parent or legal guardian who signs the participation waiver or accompanies the minor to the facility. Parents or guardians may opt out of their child being photographed or filmed by notifying a staff member in advance.
7. Third-Party Services and Data Sharing
7.1 Third-Party Service Providers
We work with trusted third-party service providers who process data on our behalf. These providers are contractually obligated to protect your information and may only use it for the specific purposes we direct. Our key service providers include:
- Court Reserve: Our court booking and membership management platform. When you create an account, book a court, or purchase a membership through Court Reserve, your personal and payment information is processed through their system. Court Reserve's privacy practices are governed by their own privacy policy.
- Netlify: Our website hosting and form submission provider. Netlify processes data submitted through forms on our Site and hosts our web content. Netlify's privacy practices are governed by their own privacy policy.
- Meta Platforms (Facebook/Instagram): Provides advertising, analytics, and audience measurement services through the Meta Pixel installed on our Site. See Section 5.2 for details.
- Payment processors: Third-party payment processors (including Stripe and/or other processors used by Court Reserve) handle credit card and other payment transactions. These processors are PCI-DSS compliant and do not share your payment card information with us beyond what is necessary to complete your transaction.
- Email and SMS marketing providers: We use third-party platforms to send marketing emails and text messages. These providers have access to your name, email address, and/or phone number as needed to deliver communications on our behalf.

- Account information: Retained for the duration of your active account and for up to 3 years after account closure or last activity, unless you request earlier deletion.
- Transaction and payment records: Retained for a minimum of 7 years to comply with tax, accounting, and financial reporting obligations.
- Marketing and communication preferences: Retained until you withdraw consent or opt out, after which we will retain only enough information to honor your opt-out request.
- Waivers and release forms: Retained for a minimum of 7 years from the date of execution, or longer if required by applicable law or pending litigation.
