Welcome to Access Padel Club. These Terms and Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("Participant," "Member," "User," "you," or "your") and Access Padel Club LLC ("Access Padel," "Company," "we," "us," or "our"), a New Jersey limited liability company, located at 330 Roycefield Rd, Building G, Units 3 & 4, Hillsborough, NJ 08844.
By entering our facility, using our courts, booking through our website or booking platform (book.accesspadelclub.com), purchasing a membership, participating in any program, lesson, clinic, league, tournament, or event, or otherwise using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use our facility or services.
These Terms apply to all visitors, guests, members, participants, spectators, and any other individuals who enter the Access Padel Club premises or use our services in any capacity.
Padel is a physical sport that involves vigorous physical activity. You acknowledge and understand that participation in padel and use of the Access Padel Club facility involves inherent risks of serious bodily injury, permanent disability, paralysis, and death. These risks include, but are not limited to:
BY ENTERING THE ACCESS PADEL CLUB FACILITY OR PARTICIPATING IN ANY ACTIVITY, YOU VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, DAMAGE, OR DEATH ARISING FROM YOUR PARTICIPATION, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF ACCESS PADEL CLUB LLC, ITS OWNERS, OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, INSTRUCTORS, COACHES, OR VOLUNTEERS, OR OTHERWISE.
YOU HEREBY WAIVE, RELEASE, AND FOREVER DISCHARGE ACCESS PADEL CLUB LLC, ITS OWNERS, OFFICERS, MEMBERS, MANAGERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, INSTRUCTORS, COACHES, VOLUNTEERS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE "RELEASED PARTIES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, SUITS, COSTS, EXPENSES, AND DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO YOUR USE OF THE FACILITY, PARTICIPATION IN ANY ACTIVITY, PROGRAM, LESSON, CLINIC, LEAGUE, TOURNAMENT, EVENT, OR SERVICE, WHETHER ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.
THIS WAIVER AND RELEASE INCLUDES, WITHOUT LIMITATION, CLAIMS FOR PERSONAL INJURY, BODILY INJURY, DEATH, PROPERTY DAMAGE, EMOTIONAL DISTRESS, LOSS OF CONSORTIUM, AND ALL OTHER LOSSES OR DAMAGES OF ANY KIND, WHETHER KNOWN OR UNKNOWN, ANTICIPATED OR UNANTICIPATED, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE FACILITY OR PARTICIPATION IN ANY ACTIVITY.
YOU AGREE THAT YOU WILL NOT SUE OR BRING ANY CLAIM, DEMAND, OR ACTION AGAINST THE RELEASED PARTIES FOR ANY INJURY, DAMAGE, OR LOSS ARISING FROM YOUR USE OF THE FACILITY OR PARTICIPATION IN ANY ACTIVITY. THIS COVENANT NOT TO SUE IS BINDING UPON YOU, YOUR HEIRS, EXECUTORS, ADMINISTRATORS, PERSONAL REPRESENTATIVES, AND ASSIGNS.
You agree to indemnify, defend, and hold harmless Access Padel Club LLC, its owners, officers, members, managers, directors, employees, agents, contractors, instructors, coaches, volunteers, representatives, successors, and assigns from and against any and all claims, demands, actions, causes of action, suits, judgments, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:
This indemnification obligation shall survive the termination of your membership, use of the facility, or these Terms.
By participating in any activity at Access Padel Club, you represent and warrant that:
Access Padel Club does not provide medical advice, diagnosis, or treatment. Our coaches, instructors, and staff are not medical professionals. If you experience any pain, discomfort, dizziness, shortness of breath, or other symptoms during activity, you must immediately stop and seek medical attention. You are solely responsible for monitoring your own physical condition during all activities.
In the event of a medical emergency, you authorize Access Padel Club and its staff to contact emergency medical services on your behalf and to provide basic first aid as they deem appropriate. You agree that any costs for emergency medical treatment or transportation shall be your sole financial responsibility.
You must be at least 18 years of age to agree to these Terms, purchase a membership, or book a court on your own behalf. Individuals under 18 years of age ("Minors") may participate in activities at Access Padel Club only with the express written consent of a parent or legal guardian.
If you are a parent or legal guardian signing these Terms on behalf of a Minor, you:
Minors under 16 must be accompanied by a parent or legal guardian at all times while on the premises, unless actively participating in a supervised program, lesson, or clinic. Access Padel Club is not responsible for the supervision of Minors. Parents and guardians assume full responsibility for any injury, damage, or loss arising from a Minor's use of the facility.
Court reservations are made through our booking platform at book.accesspadelclub.com (powered by Court Reserve) or through the Access Padel mobile app. Payment is required at the time of booking unless otherwise specified. All bookings are subject to court availability.
Cancellations must be made in accordance with the following policy:
Access Padel Club reserves the right to modify the cancellation policy at any time. Any changes will be posted on the booking platform and/or communicated to members.
If you fail to arrive within 10 minutes of your scheduled booking time, your reservation may be forfeited without refund. Repeated no-shows (three or more within a 30-day period) may result in temporary suspension or permanent revocation of booking privileges.
Courts will not be extended due to late arrival. Your session ends at the originally scheduled time regardless of when you begin play.
Refunds, where applicable under the cancellation policy, will be processed to the original payment method within 5–10 business days. Access Padel Club reserves the right to issue credits in lieu of refunds at its sole discretion. Private lessons, clinics, and special events may have separate cancellation and refund policies, which will be communicated at the time of booking.
Access Padel Club offers various membership plans with different benefits, pricing, and terms. Membership details, including pricing, benefits, and eligibility, are available on our website and booking platform. All memberships are subject to availability and Access Padel Club reserves the right to limit the number of memberships offered.
By purchasing a membership, you authorize Access Padel Club (or its payment processor) to charge your designated payment method on a recurring basis (monthly, annually, or as specified by your selected plan) until you cancel your membership. You are responsible for keeping your payment information current. If a payment fails, we reserve the right to suspend your membership privileges until payment is received.
To cancel your membership, you must provide written notice by emailing info@accesspadelclub.com or through the booking platform. Cancellations must be submitted at least 15 days prior to the next billing date. Cancellations submitted after this deadline will take effect on the following billing cycle. No refunds will be issued for partial billing periods. Any outstanding balance must be paid in full upon cancellation.
Membership freezes may be available upon request for documented medical reasons or extended travel. Freeze requests must be submitted in writing to info@accesspadelclub.com. Freeze terms, including duration and fees (if applicable), are at the sole discretion of Access Padel Club.
Memberships are non-transferable. You may not share, sell, assign, or transfer your membership to any other person. Memberships are for the sole use of the named member. Misuse of membership privileges may result in immediate termination without refund.
Access Padel Club reserves the right to change membership pricing at any time. Existing members will receive at least 30 days' notice before any price increase takes effect. Continued membership after the effective date of a price change constitutes acceptance of the new pricing.
Access Padel Club reserves the right to suspend or terminate any membership at any time, with or without cause, including but not limited to violations of these Terms, the Code of Conduct, or any facility rules. In the event of termination for cause, no refund will be issued. In the event of termination without cause, a prorated refund for the remaining prepaid period will be provided.
All participants, members, guests, and visitors are expected to conduct themselves in a respectful, sportsmanlike manner at all times while on the premises. The following behaviors are strictly prohibited:
Appropriate athletic attire is required for court play. Participants must wear:
Violation of the Code of Conduct may result in a verbal warning, removal from the facility, suspension of membership or booking privileges, permanent ban from the facility, or legal action, at the sole discretion of Access Padel Club. No refunds will be provided in cases of removal or suspension for Code of Conduct violations.
Standard court bookings are subject to the time durations and scheduling increments established by Access Padel Club. During peak hours, bookings may be limited. Access Padel Club reserves the right to modify scheduling policies, court allocations, and time limits at any time.
Members may bring guests to the facility subject to the following conditions:
Access Padel Club operates during posted hours, which are currently Monday through Thursday from 6:00 AM to 10:00 PM and Friday through Sunday from 6:00 AM to 11:00 PM. Hours are subject to change without notice for holidays, special events, maintenance, or other reasons. Check the website or booking platform for current hours.
Access Padel Club is not responsible for any personal property that is lost, stolen, damaged, or destroyed on the premises, including but not limited to clothing, equipment, electronics, jewelry, and vehicles. You are solely responsible for safeguarding your personal belongings. Unclaimed lost and found items may be donated or disposed of after 30 days.
Access Padel Club provides parking areas for the convenience of participants and visitors. Parking is at your own risk. Access Padel Club is not responsible for theft, damage, or loss of any vehicle or its contents while parked on or near the premises.
BY ENTERING THE ACCESS PADEL CLUB FACILITY, YOU CONSENT TO BEING PHOTOGRAPHED, FILMED, VIDEOTAPED, AND OTHERWISE RECORDED by Access Padel Club, its employees, agents, contractors, and authorized representatives, by any means or medium, including but not limited to still photography, video recording, livestreaming, closed-circuit television (CCTV), and surveillance cameras.
You hereby grant Access Padel Club LLC a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive license to use, reproduce, distribute, display, modify, edit, create derivative works from, and publicly perform your name, image, likeness, voice, statements, and any photographs, videos, recordings, or other content captured at the facility for any purpose, including but not limited to:
You waive any right to inspect, approve, or receive compensation for the use of any content in which you appear. You release Access Padel Club from any claims arising from the use of such content, including but not limited to claims for invasion of privacy, defamation, right of publicity, or copyright infringement. You acknowledge that Access Padel Club retains all right, title, and interest in and to any content created by or on behalf of Access Padel Club.
Participants may take personal photographs and videos at the facility for non-commercial use. Commercial photography, videography, or livestreaming is strictly prohibited without the prior written consent of Access Padel Club. Any content you capture at the facility and share publicly should appropriately credit Access Padel Club.
By providing your phone number to Access Padel Club (whether during registration, booking, membership sign-up, or any other interaction), you expressly consent to receive text messages (SMS and MMS) from Access Padel Club LLC at the phone number you provided. These messages may include:
Message frequency varies based on your activity, preferences, and promotional campaigns. Message and data rates may apply depending on your mobile carrier and plan. Access Padel Club is not responsible for any charges imposed by your carrier for receiving text messages.
You may opt out of receiving text messages at any time by replying STOP to any message from Access Padel Club. After opting out, you will receive a confirmation message and will no longer receive promotional text messages. Note that opting out of promotional messages does not opt you out of essential transactional messages related to your bookings or account.
Carriers are not liable for delayed or undelivered messages. Access Padel Club is not responsible for messages that are not received due to carrier issues, device compatibility, or incorrect phone numbers provided by the user.

All content, materials, and intellectual property associated with Access Padel Club, including but not limited to the name "Access Padel Club," "Access Padel," logos, trademarks, service marks, trade dress, website content (accesspadelclub.com), graphics, images, photographs, videos, text, software, designs, and all other proprietary materials, are the exclusive property of Access Padel Club LLC or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, download, store, transmit, or otherwise use any intellectual property of Access Padel Club without the prior written consent of Access Padel Club LLC, except as follows:
Any unauthorized use of Access Padel Club's intellectual property may result in legal action, including claims for damages and injunctive relief.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF ACCESS PADEL CLUB LLC, ITS OWNERS, OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND CONTRACTORS, ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THE FACILITY, OR ANY SERVICE PROVIDED BY ACCESS PADEL CLUB, SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO ACCESS PADEL CLUB IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.
IN NO EVENT SHALL ACCESS PADEL CLUB LLC OR ANY OF THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, YOUR USE OF OR INABILITY TO USE THE FACILITY, OR ANY SERVICE PROVIDED BY ACCESS PADEL CLUB, REGARDLESS OF THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF ACCESS PADEL CLUB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You acknowledge that Access Padel Club has set its fees and entered into these Terms in reliance upon the limitations of liability and the disclaimers set forth herein, and that the same form an essential basis of the bargain between the parties.
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of laws principles.
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THE FACILITY, OR ANY SERVICE PROVIDED BY ACCESS PADEL CLUB, INCLUDING THE DETERMINATION OF THE SCOPE OR APPLICABILITY OF THIS AGREEMENT TO ARBITRATE, SHALL BE DETERMINED BY BINDING ARBITRATION administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator.
The seat of arbitration shall be Somerset County, New Jersey. Any judicial proceeding necessary in connection with the arbitration (including enforcement of the arbitration agreement or any arbitral award) shall be brought exclusively in the state or federal courts located in Somerset County, New Jersey, and you hereby consent to the personal jurisdiction and venue of such courts.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Access Padel Club LLC.
Any cause of action or claim you may have arising out of or relating to these Terms or the use of the facility must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.
In any arbitration or legal proceeding arising under these Terms, the prevailing party shall be entitled to recover reasonable attorneys' fees, costs, and expenses from the non-prevailing party.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the provision. If modification is not possible, the provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of any other provision of these Terms, and all remaining provisions shall continue in full force and effect.
Access Padel Club reserves the right to modify, amend, update, or replace these Terms at any time, at its sole discretion. Changes will be effective upon posting the revised Terms on our website at accesspadelclub.com with an updated "Last updated" date. We may also notify you of material changes via email, text message, or notice posted at the facility.
Your continued use of the facility, services, or membership after any changes to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically. If you do not agree to any modified Terms, you must discontinue use of the facility and cancel your membership.
Your use of our facility and services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By agreeing to these Terms, you also acknowledge and consent to the practices described in our Privacy Policy.
Access Padel Club shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government orders or restrictions, war, terrorism, civil unrest, power outages, internet or telecommunications failures, equipment failures, labor disputes, fire, flood, severe weather, or any other event beyond the reasonable control of Access Padel Club.
Access Padel Club utilizes third-party platforms and services, including but not limited to Court Reserve (booking platform), payment processors, and communication services. Your use of these third-party services is subject to their respective terms of service and privacy policies. Access Padel Club is not responsible for the availability, accuracy, content, or practices of any third-party services. Any issues arising from the use of third-party services should be directed to the respective third-party provider.
These Terms, together with the Privacy Policy and any separate waivers, agreements, or forms you may sign in connection with specific programs, events, or services, constitute the entire agreement between you and Access Padel Club LLC with respect to your use of the facility and services. These Terms supersede all prior or contemporaneous communications, representations, understandings, and agreements, whether oral or written, between you and Access Padel Club LLC relating to the subject matter hereof.
No failure or delay by Access Padel Club in exercising any right, remedy, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise thereof preclude any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege. The rights and remedies provided herein are cumulative and not exclusive of any rights or remedies provided by law.
You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of Access Padel Club LLC. Access Padel Club may freely assign, transfer, or delegate its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.
Any notices required or permitted under these Terms may be given by Access Padel Club by email, text message, posting on the website, or posting at the facility. Notices from you to Access Padel Club must be sent in writing to:
